FLR(M) or FLR(FP) - late spouse visa extension application

Hi to all members on the forum and those viewing this topic.
I am hoping someone can help me.

Spouse arrived in the UK on spouse visa (Appendix FM) and granted visa for 2.5 years. Visa expired early March 2022 but failed to make an application to extend in time (before visa expiry). No good reason for failure to apply - just forgot about it. In the process of getting documents together to make an application for Further Leave to Remain (FLR) now.

Now also have a child who is a British Citizen.

Which form needs to be completed - FLR(M) or FLR(FP)?
Is there a real chance of success with making the application?
What should be included within the application?

All comments and experience much appreciated.

Oh heck that’s not good - how can you forget the expiry date of Visa, anyway here’s the link for FLR FP application https://www.gov.uk/government/publicati ... orm-flr-fp

You must also write a cover letter explaining why didn’t you applied visa in time.

You can still apply for either FLR M or FP, provided you can fulfil either criteria. You just need to know that regardless of which one you go for, you guys are just starting your immigration journey afresh. The first 2.5 years is gone.
No sin in failing, you just have to try and try again!

This reads like he can no longer use the NHS without being billed (unless that service is free)? He might want to get private health insurance.

People who have paid the surcharge (or who are exempt from having to pay it or have had the requirement waived) can use the NHS in a similar same way to an ordinarily resident person while their visa remains valid.

From 6 April 2015, unless an exemption or waiver applies, the applicant for leave to enter or remain in the UK for 6 months or more must pay the immigration health surcharge ("surcharge") to cover this period of time. Nope, as an overstayer having applied after visa expiry, not allowed to work

And again here for having to pay the NHS-

5,8 An individual who pays the health surcharge is only entitled to free treatment on the same basis as an ordinary resident (but excluding assisted conception services)once their application for a visa has been granted, and not from the date when the health surcharge is paid. The exemption from charges for relevant services applies to the period of leave to enter or remain in the UK granted to the person. Once that leave expires or is curtailed, the person becomes liable for charges from then on, including where the person is part-way through a course of treatment unless an exemption in the charging regulations applies.

Yes it's all online. FLR(M) would put you back on the 5 year path to ILR, whilst FLR(FP) would put you on the 10 years path to ILR.
My advise, if you can fulfil the criteria for FLR (M), go for that. After 5 years, you can apply for ILR. However, you can't apply for citizenship until 10 years has passed since your overstay. Hence you save yourself 5 years visa fee plus surcharge technically.

don't waist your time in here you should seek advice from citizens bureau advice as soon as possible.
