Need help!!

Post by pra_S » Mon Nov 24, 2008 9:38 am

Hi All,

My wife's visa application was refused, and I lodged appeal against the decision to AIT. I am work permit holder and fullfilled all the necessary requirements and the visa officer himself satisfied I cover all the rules except one. He confused with my company structure he's not sure that I am working exactly for the same company stated in the WP.

Is it possible to advice me, can they come up with any additional points (not mentioned in the refusal letter) on the hearing date? is it necessary to submit all the documents again to them(latest bank statement, rental agreement) etc?

Please advice me on this?

MM (Allowed appeal: further refusal) Pakistan [2008] UKAIT 00040 wrote:An executive officer is generally speaking obliged to act in accordance with a decision of the Tribunal allowing an appeal. That principle, however, does not prevent the application being refused again on different grounds from those given the first time, especially where the earlier determination cannot be regarded as having adequately dealt with the evidence and facts underlying the new ground.
