Tier 1 general application

Hello,

can someone please help with this situation.

I obtained my master results beginning of August 2008

I came in Uk in March 2002 on student visa.

(i) I studied for a degree, March 2002 to Febuary 2005 at college A

(ii) Febuary 2005 to March 2008 i enrol on a second degree course from college B

(iii) After year 1 of second degree, I switch college and enrolled on the same degree course but with a different college C. ( 3rd April 2006 to April 2007)

(iv) April 2007, I stopped the second degree course with only transcripts for year 1 and year 2.

(v) I enrol on a Master from April 2007 to March 2008.

Since I came in UK, I have renewed my student visa 3 times without problem

I am currently on Tier 1 Post Study Work since September 2008.


I want to convert to Tier 1 general in Febuary 2009 next year using my back home salary earned before i came to UK as full-time student.

Before I came to this country as a student, i was working full-time in my home country.

I have the salary slips and tax certificate to confirm my income from March 2001 to Febuary 2002.

Using the calculator, it gives me 80 points.

I read in tier 1 general guidance on page 16 the following:

"


85. The provision for full-time study is designed


to allow an applicant to claim points for previous


earnings under Tier 1 (General) if he/she has not


been able to earn any money during the 12 months ( ??? this is my confusion)


before the application because of a period of full-time


study. This is only available to initial applicants to Tier

1 (General).






86. To qualify for the full-time study provision an


applicant must establish that he/she either:


• is currently in full-time study; or


• has finished a full-time course within the 12 months

immediately before his/her application. "

I am not in a full-time job yet. I am still in my 20 hours part-time job but i do overtime occasionally.

From april 2008 to March 2009, I am not sure I am going to hit £20,000 salary to get 20 points on Tier 1 general using UK salary, am more confident I will hit £17,000. That's why am using my salary before i came to study for my degree and my master

My concern is because I am already on Tier 1 PSW and working, will my application be eligible if applied in April 2009 using the 12 month income in 2001& 2002 ??


A second question, when it's written in the guidance "has finished a full-time course within the 12 months", for my master course, does this mean the date when i was first notified of my result or the date i submitted my dissertation?


Please help, really appreciate this forum and dedicated members.
