Can I apply Now under MN1 3(1)

Can I register my son he was born abroad without ILR under section 3(1) ?
Father: ILR
Mother: ILR
Three children: British ( born in the UK)
Can I register him under this section ? he lived in the UK more than 10 years ( different types of visas) current one ( child route valid until 3/2024) Or I need to wait until I apply for BC ? Page 16 of 27 from A guide

“Children who have lived in the UK for more than 10 years
Children will come within this category if:
• the child is in the UK lawfully
• the parents are in the UK lawfully
• both parents give their consent to registration (unless good reasons are
provided)
• there is no reason to refuse on character grounds.”
