Applying for ILR with Limited Company

Post by Jo962 » Mon Feb 20, 2023 1:32 pm

Hello,

I am currently on Skilled worker visa with my family, i become eligible for ILR end of this year.

I work as a doctor, and i often do locum shifts in addition to my work with my main sponsor.

Some friends suggested i create a limited company to manage my locum work so i recently did, and i hired my wife as a secretary to help me arrange all paperwork and appointments etc.

Having started the limited company, i am technically its director. However I do not pay myself any salary for that and i do it in my own time.

I only do around 10 hours of locum work a week on average (never above 20 hours).

I am not due my first taxes until after i become eligible to apply for ILR.

My question is:
Would being the director of the company affect my ILR application in any way? Or affect my wife's application?

Thank you.

You are not permitted to be self employed on a Skilled Worker visa.

Your supplementary job must be through PAYE with the company you are working through, not your own company.

And if that is one of the tax dodge schemes, you will have got yourself in trouble in HMRC FIS (Fraud Investigation) too.

Even those who have closed their LTD company, are getting letters form HMRC that state they are goiong to court to apple to have that company re-opened.

Hi,
I’m in the same situation right now but it’s my husbands limited company that has been running for 6 months only.
Do we have to include it as a source of income if we can meet the financial requirement from other sources such as salaried employment as the company hasn’t been running for a full financial year?
Have you got a decision and did the company affect your ILR application?

If salaried employment income meets the financial requirements then use it and it won't affect negatively.
