spouse visa - overstayed and ban for 10 years

Hi There,

My friend is going to apply for Spouse visa and need some help please

1, He came to UK as visitor back in 2017, and overstayed for couple of months but went back voluntarily.
2, He applied visit visa again in 2019 and didn't mentioned overstayed in documents so visa refused and got ban for 10 years.

He got married to an EU Citizen stale in UK and got a one month old child, both wife and child are in UK.

he is going to apply spouse visa worried about whether there can be any impact of previously overstayed and ban on his application this time.

A 10 year ban is exactly that - a ban for 10 years. It doesn’t matter who he is married to.

It will certainly be almost impossible to overturn that ban IMHO, if at all possible and will take years to do, and cost a fortune and be more trouble than it's worth. Didn't they even consider whether they could live in the UK before they got married - presumably in his country?

The HO will expect her to go live with him I expect.

Plus, does she meet all the other criteria such as salary, place to live etc etc. Does he have correct English exams, and do they have the £ to apply for the visa and NHS surcharge which should not be forgotten, if they are going to try.
