Question about the Reckonable Residence Calculation

Post by Yuki_Vm_2023 » Fri May 26, 2023 9:24 pm

Hi, I wonder if someone could shed some light on the Reckonable Residence Calculation for the citizenship application. I am a bit confused about when should I start counting my Reckonable Residence, how should I add the extra days if one of the 5 years I was outside of Ireland for more than 6 weeks and how should I decide my application date?

This is the 5 year based on my first stamp 1 since Nov 2019. My understanding is if I got all my documents correct and I never went above the 6-week rule, then I would be ready to submit my application in Nov 2024.

Nov 2019 - Nov 2020
Nov 2020 - Nov 2021
Nov 2021 - Nov 2022
Nov 2022 - Nov 2023
Nov 2023 - Nov 2024

However, I have no bill/rent agreement between Nov 2019 and May 2020 as I stayed at a friend's place, I do have a recommendation letter from them, but I don't know how valid it could be.

Question 1 - Could I choose to start from Jan 2020 for my 5 years like below?
Since June 2020 until now, every year I have either bill or rent agreement under my name. Does this look better?

Jan 2020 - Jan 2021
Jan 2021 - Jan 2022
Jan 2022 - Jan 2023
Jan 2023 - Jan 2024
Jan 2024 - Jan 2025

Question 2 - Let's say I will be able to use the 5 years starting from Jan 2020. During the period of Jan 2022 to Jan 2023, I was outside of Ireland for 60 days. All other years, I followed the 6-week rules.

Where should I add the 60 days? From Jan 2025? then my application date would be Mar 2025?
Then from Jan 2024 to Mar 2025 (during this 1 year and 2 months), I cannot be outside of Ireland for more than 6 weeks for the last year of continuous reckonable residence?

Question 3 - I still use the 5 years starting from Jan 2020. I have my bills/rent agreement shown as below, does this look okay? As 1st year and 3rd year, I would have a few months without a rent agreement or bills.

Jan 2020 - Jan 2021 - Rent agreement - June 2020-June 2021 (Jan to May - No documents as stayed with a friend)
Jan 2021 - Jan 2022 - Rent agreement/Bill-June 2021- Aug 2022
Jan 2022 - Jan 2023 - Rent agreement/Bill-June 2021- Aug 2022 (Aug to Dec - No documents as stayed with a friend)
Jan 2023 - Jan 2024 - Rent agreement/Bill Jan - Dec
Jan 2024 - Jan 2025 - Rent agreement/Bill Jan - Dec

I know It might be early to think about an application date, but I want to start to organize my paper works accordingly as I already have some documents missing over the years. Hope someone could advise. I really appreciate your kind help.

If you apply past Jan 2025 - sure; you need 5 out of 9 years.

Yes. you add it to your total 5 year census (so your needed time in Ireland is 5 years + 60 days).

No; last year has to be continuous residence, meaning if you leave for more than 6 weeks, it doesn't count and you need to do another year. Source: https://www.oireachtas.ie/en/debates/qu ... 12-15/288/
In both cases, the final 12 months must be continuous residence in the State with up to 6 weeks allowed to facilitate foreign travel for business family or holiday purposes

You need to score 150 points via the Scorecard system - https://www.irishimmigration.ie/wp-cont ... dency.xlsx
You have rent agreement (50 points) and Bill (10 points?). Can you explain how do you get 150 points each year?

Keep in mind things might change drastically before 2025, as it happened with the Scorecard system.

I am using the start date from my first stamp and calculating based on the new guidance in May 2023: https://www.irishimmigration.ie/wp-cont ... cument.pdf

Nov 2019 - Nov 2020 Type A: Employment Detail Summary 100 points, 2 Rental Agreements (Nov 2019-June 2020, June 2020-June 2021 - (50 points) --- Is the rent agreement part okay?
Nov 2020 - Nov 2021 Type A: Employment Detail Summary 100 points, Rent Agreement/Bills - (50 points) -- How many bills need to be provided?
Nov 2021 - Nov 2022 Type A: Employment Detail Summary 100 points, Rent Agreement/Bills - (50 points)
Nov 2022 - Nov 2023 Type A: Employment Detail Summary 100 points, Rent Agreement/Bills - (50 points)
Nov 2023 - Nov 2024 Type A: Bank statement(as Employment Detail Summary could only be applied at the end of the year) 100 points, Rent Agreement/Bills - (50 points)

Is the rent agreement part okay?
Hopefully - that's extremely new guidance, no definite answer yet.

How many bills need to be provided?
As a) each bill was 10 points by the old Scorecard system and b) bank statement mentioned 6 months, I'd say providing 6 bills per each period should do the job.

You need 3 consecutive months of bank statements (with 3+ point of sale transactions) issued by a bank regulated by Central Bank of Ireland or European Bank. (Page 6 of the new guidance.) Page 11 and page 3 is explicit that you should only send required amount of proofs and not more.

what would be the scenario where IRP card as expired during Covid Lockdown and renewal was not possible and now shows a gap in residency calculator of 4 months? Do I need to wait or just apply?

Did you have a legal permission for the duration of these 4 months (and were you in Ireland)? People mentioned applying for permissions like LTR with an explanatory note about it and it went through okay; not sure about citizenship, but if you want to make sure, stay for another 4 months (I assume year in question isn't the one just before the application) and explain it in the cover letter.

Yes, I had a valid Employment permit around that time. it is just that I could not renew my IRP as burg quay IRP office where closed. I recently applied for Stamp 4 based on 5 years on General Employment permit and that went through without any issue. Waiting for another 3/4 months would be better rather than getting a rejection.
