Child under 18 Years Old

Post by Ahmd_64 » Mon Jul 17, 2023 10:58 am

Dear,

My sister wants to apply Work Permit under a care Visa. She has two Sons and both are between 15 to 17 years. Her husband does not want to go UK at the moment for business reason etc.
Can her kids apply dependent visa and go with mother if husband gives consent letter for it.
Thanks.

Thank you for your Reply.

One more question on the behalf of my friend.

He got work permission of short list occupation under asylum application.
This right of work under asylum is valid until February 2024.

Can his Wife apply work permit from out of UK
Or even if his girl wants to apply student visa from home country.
Will they get visa or not?
What is in this scenario for them?

Refugee family reunion: a user’s guide.
He Has Just applied Asylum last year and Got ARC Claimed ID Asylum card which mean asylum is under consideration. So his wife got Care Home permit offer. Kids are 15 years and 17 Years old. according to him he has not declared wife and kids in application even passport or any ID. Just simple date of birth, Back home city and Name.
will his wife get work permit visa and kids as well? if not then any solution or idea?

Yes, you gave reunion link but it is for that person who has been granted asylum. My question is
If asylum is under consideration and got ARC Claimed ID Asylum Card only.

Her husband has claimed asylum, but is not currently in the UK? If he is still using his national passport for travel or returns home without the Home Office’s consent, then he may lose his asylum claims.

Why can’t my children join me in the UK?
If your sister has sole responsibility, etc, then she may be able to bring her children with her as dependants on her Skilled visa.

Unlikely that the Home Office will grant a skilled worker visa under a sole responsibility umbrella. The evidence that would be required would be the demonstration of care and provision of care while the worker was employed. Care workers are not well paid and usually work a 24/7 shift system so that would point to a position that would not readily suggest care will be able to provided at the appropriate level of care without family members being involved.
