Applying again EUTR1

Post by Akhi27 » Tue Aug 01, 2023 7:15 pm

Hi
I am planning apply again for Eutr1 application after 5 year in Ireland, Applied for Eutr3 but refused as I have a gap year. I am currently living in Ireland (temp stamp till next month), this time I am applying Under the EUTR1 withdrawal agreement as my husband is UK national. we were living in Ireland he is started working before 31 December 2020 and continuing.

Is it ok to apply EUTR1 under withdrawal agreement?
Thank you

From the form (https://www.irishimmigration.ie/wp-cont ... -EUTR1.pdf):
Citizens’ Rights entitlements guaranteed to United Kingdom nationals and their family members
are given effect in Ireland under the European Union (Withdrawal Agreement) (Citizens’ Rights)
Regulations 2020.
[...]
References to EEA national in this form shall be deemed to also apply to a United Kingdom
national who satisfies the relevant criteria under the Withdrawal Agreement.
If you've gotten EUTR permission before, most likely you'll be fine applying via this form. Be aware you won't get Stamp 4EUFam anymore.

Hi @Akhi27,

On which ground they refused your EUTR3 application? Can you share some points from your refusal letter.

And yes you can apply again EUTR1 under withdrawl agreement.

It's because an EEA citizen spent some time studying outside of the state during the 5 year.
thanks for the reply.
