FLR FP based on spouse or children

Post by naija99 » Thu Sep 21, 2023 11:07 am

Please could one of the gurus advise me and I'm asking on behalf of a friend.
She applied FLR FP based on marriage to a British citizen husband they have two British kids who were granted their citizenship through their British father. She applied priority but it has been delayed. Her husband has received notice to deprive of his citizenship and he has appealed. He is waiting for a hearing date.

Can she submit a fresh application FLR FP based on the British children? Or should she just email the Home Office and request her original application to be varied?

Was the deprivation notice to the father after the mother's application? Was it triggered by the mother's application?

If the father is eventually deprived of citizenship, isn't there a possibility it will affect the children who you say got their citizenship through him?

Deprivation of citizenship only happens in the very most serious of circumstances so there is a considerable back story to this case. I don’t believe there is any advice that could be given that is likely to address the issues until such time as the outcome of the citizenship is known.

Thank you
The only advice sought at the present time is simply on procedure to submit the fresh application. Is it by completing another online form or would it be to email the home office and request a variation to her original application which has not yet been considered?

I'm not sure what you want to hear. You've been advised that there's nothing that can be said at this juncture. The application and any application has come to a standstill.

Everything is centered around the husband's British citizenship in question. The children likely wouldn't have any known status (derived from their dad) if the husband is deprived. The husband wouldn't have any either. So if she's planning to apply based on the status of either of her family, what status would that be?

The best advice at this moment is wait for the outcome of the citizenship appeal. If the appeal is granted (that is very very unlikely) then the current application will be processed as is. If the appeal fails then there will be an option to vary to rely on the children BUT if the father’s circumstances dictate that the children lose their citizenship too (harsh and unlikely) then there will be an issue for the whole family.
