Dependent Child - Self Employed

Post by AliJaf » Thu Feb 01, 2024 11:49 pm

Hello,
Can a PBS dependent child who has not turned 18 now (was 17 when entered UK), is in full time education - A Levels (delayed start and gap years) be self employed as sole trader

Will it by any means constitute as being non-dependent / starting own life at a later stage during visa renewal or ILR, as Home office asks for bank statement to prove they are still being supported by the parent?

Please guide.

Thanks

IMHO, May be better to have scaled the immigration hurdles before going on that path.
Leaving it to more knowledgeable persons and zmODs to give their views.

The over 18 “child” dependent must continue to be fully dependent on the main visa holder. If they undertake self employment then they will almost certainly fall out outside of the definition that allows them to remain as your dependent.
Even undertaking general employment will potentially push them outside the narrow definition.

If your child has received a dependant visa before they turned 18, they can continue to extend this visa even when they turn 18 during the visa validity. Your child must also not have started an independent life, which means they are unmarried, still living with you and/or are financially dependant on you, and do not have children of their own.
