Skilled Worker Visa - Extension Confusion

Post by iamwellandgood » Mon Apr 01, 2024 2:09 pm

Hello Moderators and Members,

I wanted to ask few questions on behalf of a friend. So my friend came to the UK on a skilled worker visa with her family in 2022 and her BRP says expires 31/12/2024. She's confused about a few things and wanted to ask a few questions if anyone can help.

1) Since all BRPs (including old and new) expire end of 2024, how to know the actual date of visa expiry?

2) How soon can you apply for visa extension? 1 month or 3 months before expiry?

3.1) Can you change employer on visa extension?
3.2) If yes, will it be an extension or new application?
3.3) Will the new rules of skilled worker including £38700 salary apply if they change employer?
3.4) If changed, will the time on their current visa be counted on 5 year ILR route? Meaning they would be eligible for ILR after next 2 years?

4) They had a new born last year, in 2023 and they've not yet applied for his passport. They're not planning to go out of country for next 2-3 years. Is it mandatory to get baby's passport and apply for his visa at this extension stage?

Any advise would be very helpful.

Thank you very much

1) Since all BRPs (including old and new) expire end of 2024, how to know the actual date of visa expiry? Check decision letter

2) How soon can you apply for visa extension? 1 month or 3 months before expiry? You can apply any time, people only plan it such that there will be no shortfall towards ilr eligibility. When was the visa issued?

3.1) Can you change employer on visa extension? No
3.2) If yes, will it be an extension or new application? At any point of changing employer, it is a sponsor switch requiring details of new sponsor and CoS.
3.3) Will the new rules of skilled worker including £38700 salary apply if they change employer?
3.4) If changed, will the time on their current visa be counted on 5 year ILR route? Meaning they would be eligible for ILR after next 2 years?
