SET (M) - Children Eligibility

Post by ederson231 » Sat May 25, 2024 12:31 pm

Hi everyone,

Father holds ILR
Mother is now applying for ILR after 5 years on partner route in the UK Set (M)
Children arrived as dependants under the same route a year and a half ago - visa expires same date as mother

Are the children eligible for settlement on the same date as the mother, potentially under para 298 IR or do they have to complete 5 years of continuous residence in the UK before applying for ILR.

Any help would be much appreciated, thanks.

There is no minimum 5 years residence for children. They apply for ILR when the parent who is applying on Set(M) does.
