ILR Dependent or SWV Dependent

Post by kmyadav » Tue Jun 11, 2024 3:28 pm

Myself M came to the UK on Mar'19. My visa at the time was from Mar'19 till Mar'24. I got married in Jan 2020 however due to COVID my wife joined me in the UK from India in Oct'20 and her visa was from Oct'20 till Mar'24. I joined another company in Jul'21 and got a new SWV visa and BRP from Jul'21 till Jul'24. At this time my company filled a visa for my wife as well and she received a new BRP from, Jul'21 to Jul'24.

Since I completed 5 years in Mar'24 I applied and got my ILR in Mar'24.

Now my wife's PBS/SWV Dependent visa is expiring in Jul'24, I am trying to apply for her visa and now the question is based on the scenario, I should be applying for her ILR dependent visa or the same as before PBS/SWV Dependent visa as she already has been in UK for 3 years and 7 months on the SWV Dependent visa and if putting her in ILR Dependent visa wouldn't that reset her 5-year route for ILR?

Thanks, @CROO1 for answering. I have a couple more questions on the same.

When applying in the form, I have the following queries:

1. I have got ILR but I am applying for SWV Dependent so for the following questions what should be the answer:
Does Mr X already have their Skilled Worker immigration permission?
Does Mr X have indefinite leave to remain or British citizenship?

2. I should mention the COS of my last SWV application ?

Thanks
