Skilled Worker - New Employer

Hi All,

I have someone who arrived in the UK in 2023 as a skilled worker (SOC code 6145) but their employer has now had their sponsor licence suspended. He has found a new employer who is willing to provide him with a COS but they are not CQC registered.

There are positions available for care workers (6135) or as a support/personal care worker but the employer wishes to know:

1. Due to the rule change in April, can the employer provide them with a COS under SOC Code 6135 (healthcare worker) given they are not CQC registered but had had COS issued prior to the rule change? I have done some research on this point and dont believe it's possible but a second opinion would be appreciated.

2. If the above is not possible, would the employer be able to provide him with a COS as a support worker e.g , where the company would not need to be CQC registered and is it possible to switch from a health care worker visa to a skilled worker visa, not under the health care category. Also what would be the relevant SOC code.

Any help would be much appreciated as this person's employer needs to know whether this is possible by the end of the month.
