Earliest I can apply for ILR - Covid delays

Post by Izzy99 » Wed Aug 07, 2024 9:49 pm

Hi

Looking for some help on when I can actually apply for ILR, given some delays due to Covid. I am on the 5 year route.

First Visa - Fiance Visa
  • Entered the UK December 2019 (Understand this does not count to the 5 years)
  • Expired 28 May 2020
Second VIsa FLR(M)
  • Applied: 27 May 2020
  • Granted: 17 September 2020
  • Expired: 17 March 2023
Third Visa FLR(M)
  • Applied: 16 March 2023
  • Granted: 31 March 2023
  • Expiring: 1 Oct 2025

Do I count the 30 months from 27 May 2020 or from 17 September 2020. There is a 4 month difference here but this was largely due to Covid slowing things down.

i.e. is the first time I can apply for ILR 27 May 2025 or 17 September 2025?

Thanks in advance.

The 5year period counts from the date spouse visa was granted as already in UK i.e. grant date +5years less 28days
Therefore eligible to apply from 20 August 2025 till the expiration date of current leave.
