Dependent Visa (Work Full Time) 5 year Can v Apply for ILR?

Post by anjum70 » Thu Jan 29, 2009 7:35 pm

Hi,
I am on Student Visa and my wife is student dependent visa.

My Question is :

1. My wife is working as an IT consultant in london and she qualifies for tier 1,Can you please guide me can she apply and submit her application from london home office for tier 1 application or she has to go to India for that?

2. As she has been working full time on student dependent visa for 2 years in london and if she continues to be working on dependent visa for 3 more years Is she will be eligible for permanent residency or will she be able to apply for ILR after 5 years of continous work on dependent visa?

Any information or highlight will be great help !!!!!!!!

Many Thanks

Look forward to hear from you

Best Regards

Anjum

1) She has to go to India for making her tier 1 application

2) She won't eligible for ILR at the end of 5 years as a dependent

None of you will qualify for ILR after 5 years' stay - because of student visa (yours) and dependent visa (spouse). Stay in UK on either of these visas does count towards ILR qualifying period (under 4/5 year rule).
