Long Residence in the UK (10 Years of Legal stay)

Post by rizcom123 » Sat Feb 07, 2009 9:23 pm

Hi,

Anyone here applied or applying for Permanent residency under LONG RESIDENCE (10 years of legal stay) category??????????? If yes, please tell me what is the process and what are the possibilities of refusing the ILR. As it's straight forward I mean if you are applying under long residence category you dont have to show your income, etc.. And are they processing this on premium service????????

Held Visa categories: 8 and half years Student and Now under HSMP
Please also clarify apart from the followings, what else needs to submit with application.

- Stamped Passport(s)
- Absence Details
- GAP details
- Life in the UK test

Do I have to submit Bank Statements, payslips etc?

Thanks,

bank statements and payslips not required under the 10 year long residence. you can if you choose to and I think this will make your case stronger.

Thanks for your advise and also please let me know whether they (Home Office) do the premium service (I mean one day service for Long residence category).

Thanks

Indeed they do. If your application is reasonably straightforward and you have all the evidence required at hand, then there is a same-day service for this.

If it's a complicated application, then it's probably better that you head down the postal route.

Hello All,

I was wondering if I could get any advice.

I have laid out my absences below which are well over the limit of 18 months for 10 year long residence and already reaching 437 days out of 450 days for citizenship.

Briefly, I’ve been in UK since 26th June 1999 and believe on 26th June 2009 (Or 28 days before 26th June 2009) I could apply under 10 YR long residency, I’m currently on PSW till OCT 2010.

The situation is since my father had a severe car accident back home ,(I’ve got medical evidences to show this fact), I was going many times back home, And have to do so every 6 months in Dubai, to avoid losing my residency there.

So my question is, I’ve got 3 passports, the oldest one is lost(didn’t have it when applied for PSW on 31st Oct 2008),the 2nd oldest is available and in there I have a stay of 7 months out of UK, and the 3rd passport, the current passport is the new passport. Now, since I’ve requested Subject access request from home office, in there, since there is only one landing card, which is even not readable, is it possible if I now claim that my 2nd oldest passport is lost, and then to arrange the dates to the most suited to reality but within the limits of the 18 months for 10 years? Would that cause a problem?

Since I know in my situation, it’s almost impossible, and it is not fair at all not to be able to get ILR after all these years and amount spent in UK.

Any ideas or recommendation?

P.S. For counting the days out of UK, I’ve calculated :
For example : Left UK on 14th Feb arriving in Dubai 15th Feb & returning 26th Feb to London, so now I take Uk Entry stamp which is 26th Feb and Dubai entry stamp which is 15th Feb and Subtract(Without considering both 15th and 26th and only counting the days in between) which is 10 days , not 11,correct?

So far for 10 YR ILR : 933 Days Absent
So far for Citizenship : Total =450-437 = 13 Days Left

Any one? Any help?

Many Thanks

Jigool
