Hello Experts,

I am working here in UK since May '08. My HSMP Visa has been approved in March '08 & i have a valid visa until March 2010. Now, i might relocate to France for a year from now. Hence, i wanted to know, whether my Visa extension (Leave to Remain), would get affected because I am not here in UK????

Can you please help me on my question please.

In order to qualify for ILR you have to follow 2 + 2 + 2 rule as you will be away from UK for more than 180 days (maximum allowed)

So to get ILR you have to wait an extra 2 years.

tapindersingh: You have mentioned 2 + 2 + 2 rules. is it mean, to get the Indefinite Leave to Remain, i should be here for 6 years? And if I move outside the country, i may need to be here for 2 more years to get the ILR?

You will b eligible for ILR if you have been resident in the United Kingdom for at least five years and have been present in the United Kingdom five years before the date of your application;

You have not spent more than 450 days outside the United Kingdom during the five year period and have not spend more than 90 days outside the United Kingdom in the last 12 months of the five-year period; and have not been in breach of the immigration rules at any stage during the five-year period.

In your case, your extra 2 year's extension will make you eligible to apply for ILR, so yes extra 2 years extension will be needed but you can apply for ILR in that time frame.

summary

You will need extension in march 2010

Another extension in march 2012

another extension in march 2014

and you will be eligible to apply for ILR in march 2013

Now, my first extension in 2010, would that be an issue, if I am staying outside UK for the whole one year, of two year validity>?
