Hi,

Well as of now rules are not declared, so better to apply with existing rules.

Yes at the time of extension, it could be a problem.

My case is also similar to yours.

But what is your thought on
B.E under Professional Course ( Engineering) getting 35 points (Masters Equivalent)

Does NARIC recognises B.E as UK Masters Equvilanet ?
If yes then we are safe.
If no then its a problem.

I would agree with the above sentiments. At present, the rules are the ones in existence and nobody is completely certain as to what the future holds. I would apply before April purely for that reason. However, I'm sure everyone will consider the other factors such as timing, economy, etc. before rushing into a decision.

Suresh,

No one is sure on the extention rules yet.. though from the past experiance BIA should not bring any changes that will impact the terms of existing Tier -1 holders.. but u never know.. but yeah.. if this happens.. lots pf people will be affected and i am sure will result in new HSMP JR.. In such a case i would not worry extn.. just initial application (Personal Thought).

All the best.

Feb Applicant

Post by bruceb » Tue Mar 03, 2009 12:43 pm

I'm a feb 09 applicant and my Visa is stamped and only valid from April 15th, i'm a bachelors degree holder too, not sure if they stop people from entering UK? is there a rule of only Masters degree holder entering? why did they stamp my visa to be valid only from Apr 15th?
i'm very confused guys!

bruceb,

I dont see any valid reason for them to stop entry just for the reason of masters degree.

Since you have the Visa in existing scheme.. it should be respected by the authorities at immigration.

Bottom line is they have issued the Visas and they will respect it.. I would still wait for the new policy.. and my gut feel says that BIA will not do any thing that will impact the rights of existing Tier 1 holders.. There should be some lessons learnt from the past experiance.. the HSMP JR.

If you get valid approval before new rules comes into picture, your extension should be gauged under old rule only. As it happened with HSMP Judicial review, HO cannot move the goal post once it grants the approval to people.

BE(Engineering) is treated as an equivalent to UK's Bachelors Degree (with Honours) by NARIC.
