how long is my hsmp valid outside britain ?

Post by sashi1979 » Fri Mar 06, 2009 10:17 pm

i got my tier 1 visa for 3 years starting october 2008, and came to the UK by nov 2008.

with the economy in this state, i plan to return back to india by april end and find a job in India and stay in India for may be 1 year or 1.5 years.

Will my tier 1 visa be valid until sep 2011 ? or will it expire under some shady clause because i happen to be out of the country?

I'm sure it will remain valid. But of course you would need to satisfy any questions by immigration officer at UK airport while returning. Better if you can get biometric (iris stuff) done, using which you need not face immigration officer.

sashi1979, Your visa will be valid till the expiry date but just consider that you need to qualify the extention criteria.. and u might face issues with ILR.. as the time in India more than 3 months your ILR counter will reset.. so might have to go for 2 extns.. (If they dont change the rules further.. surely will make it more tougher..).

I'd be very careful before utilising such a strategy. It would be highly unlikely that that you would meet the criteria for extension if you spent such a long time outside the countr, and as above posters have mentioned, it would also reset your ILR clock.
