I am calling on all people married to British citizens or permanent residents for over 4 years to contribute to this thread....
Under the current legislation we are entitled to come to the UK with ou spouses with a Indefinite Leave to Enter without the probationary period but under he proposed legislation by the Home Office,we would all fall under the same category........
No mention was made in the White paper as regarding what our status would be...which is dangerous..we could be out of the Uk for different reasons...and we are entitled to come over to the UK to settle when we deem fit.......its stupid for a 10 year married couple to come and satisfy the same pre-requisites as peolpe who just met .If you have been marries to a UK citizen or premanent resident and are living outside the UK ,lets discuss this.NOBODY WOULD FIGHT OUR CASE FOR US BUT OURSELVES .... :idea:

Two points :-
  1. No one has an entitlement, except an entitlement to apply. There are tests to be passed, and if any of them are failed then the visa application will be refused, irrespective of how long the couple have been married.
  2. Even if the visa is to be granted, (since 02.04.07) it will not be granted as ILE unless the Life in the UK Citizenship test has already been passed. If the visa is to be issued, and the couple have been together for at least 4 years, but the Citizenship test has not been passed, the spouse visa will be issued for the standard 27 months, but endorsed KOL REQ'D. This means that after getting to the UK the test can be passed, and ILR applied for without needing to wait nearly 2 years.
