2nd july applicant rejected- need advice to appeal

Dear friends,

Today I received my refusal letter from HO. I am just short of 5 points from that magic 65 points marks. I have got 60 points against my claim of 85 points. The details are here :

The reason given by HO for not giving me full 50 points and just 25 points is, in their own words:

" We were not satisfied that sufficient evidence was provided to demonstrate that your previous work experience involved 5 years specialist/senior level work as described in the published guidence notes of the HSMP arrangements. With reference to paragraph 8.2.2/ 8.2.3 of the HSMP guidence notes, you will note that senior level work experience would normally be a role at board level within a small company where there would be a evidence of your active involvement in the day to day running of the company. We were not satisfied that the evidence provided met the requirements of this category. We have awarded 25 points for graduate level work experience."

As far as work experience is concerned I submitted the following evidences on original letter heads of the company.

1) Employer Reference letter stating the position held by me, the period held during the particular period, the complete details of duties and responsibilities performed by me .

2) Organization chart showing that I have been directly working under the owner of the company and 12 persons have been reporting to me. I have to take all the marketing and sale decisions and have to formulate the entire marketing and sales strategy and just have to inform the owner of the company.
3) Appointment letter and promotion letter.


Following is the part of my experience letter stating my duties and responsibilities as an Area sales and marketing manager.


Position Held: Area Sales and Marketing Manager
Dates of Engagement: Since January 1996
No. of staffs reporting to him: 12

Work Tasks & Duties

 Recruiting, training and motivating the middle and junior level sales teams like Technical Sales Officers.
 Creating new business opportunities in his allotted territories, bargaining with the distributors and supervising the sales team.
 Creating good business relations with the distributors and farmers of his vicinity.
 Discussing all the marketing and sales problems faced by his subordinates and sort out a suitable solution.
Launching sales promotional campaigns.
 Working closely with our Sales and Product Management teams to develop and implement sector strategy
 Monitoring revenue and margin performance on a monthly basis, identifying any key issues and trends.
 Set pricing to deliver contribution targets and maintain competitive position
 Forecasting future sales, revenue and margin performance for relevant product lines.

 Total Number of years Employed: 10 Years and 3 months



So friends suggests me where did I make a mistake? Doesn't my experience letter show that I should have been given 50 points.

I have to appeal within 28 days. So friends should I send the copies or original of all the documents or just the copy of experience category only. I know that I can not send additional documents in review petition . What should I explain in my explanation letter? Any advice? Weren't my experience documents sufficient to get 50 points ?

Considering my duties and responsibilities anyone can say that only the senior person can perform these duties.

Only senior person can recruit and train other staff. I take decision whether to continue or withdraw the product from the market. Such decisions not only affect the financial position of the company but also affect its competitive position in the market. How can a junior officer take such decisions? In my organization char also it has been shown that there is no anyother senior position above me and I have to directly report to the owner of the company. Actually all the major decisions have to be taken by me and I just have to inform the owner. All these things are in my experience letter. Then how can HO not consider my position a senior level?

Any way I am very much thankful to all the members and moderators of this forum for their help and guidance at all the stage. I will provide you my further development in review petition.

Hi Atul,

Looking at your posting, it feels very unfortunate to get declined.

Write a detailed letter referencing to different portions of your experience letters - from your posting, you sound to have good communication skills and also you are a sales person. So take it that HSMP team is one of your customer and you have to persuade them to buy one of your product.

Try to prove from your letter what they have written in their rejection reasons - day to day active involvement in running the company. Focus them on duties that leads to the above statement. Also, the duties that are listed in your letter aren't well explanatory enough. Take it as HSMP case worker has aboslutely NO knowledge of what a Area Sales & Marketing Manager is and explain everything to him in detail.

In your experience letter it didnt specify that you are the Area Sales Manager for what period? It should be 5 years. Though your engagment with this company is since 96 but it is not possible that a company has hired you directly for this position. So you might have been engaged initially in graduate level work and then got promoted to this role. So they have to know specifically that you have 5 years of Senior level work experience.

As I observed, the HO have an unwritten rule:
The amount of 50 points for work experience will be awarded only in case of claiming/awarding of something in the earning section.
This is common for many applicants including me.
