How to appeal tourist visa denial?

Post by leekzn » Fri Apr 10, 2009 9:06 am

I hope this is the right board to post this!!

My partner (who is not the best at reading), filled in "NO" for the question have you ever been to the UK before. He might have jus forgotten perhaps, i really don't know, but anyway....it has resulted in his Visa being denied and he has been told in the same denial letter that he can only apply for a visa in 2018.

Is there anyway to appeal this, if there is how do we go about it? I would hate for this to pose a problem for when he is applying for a visa anywhere else.

Thanks in advance!!

this is Tier1/HSMP visa forum, so it appears your partner isn't the only one with reading problems.

my girlfriend was refused a Visitor visa for allegedly trying to deceive the immigration officers. She included copies of ALL our MSN conversations to help prove relationship, but forgot to remove my comments telling her how to complete her visitor visa application form (i.e. get latest bank statements from the bank immediately after being paid, because she doesn't earn a lot). EEdiot

She was told she could not appeal (i think u can only appeal if its your family members), and we didnt bother trying since the evidence was against us. I went and visited her instead.

I dont think she was told anything about having to wait X amount of years. So she applied again 6 months later and was successful and had a nice holiday in the UK with her shockboy. When writing my sponsor letter for the second time, i explained that it was my fault for my comments in the MSN conversation, i submitted evidence to show that i travelled to visit her (on the dates that she was rejected from coming to visit me in the uk)...and they determined we were genuine in the end.

I'd try and contact them explaining it was a mistake, and if u got no response - apply again in 6 months with an explanation from yourself in your sponsorship letter. Might be a good idea for you to go visit your partner around the same time u were intending on the partner coming to UK...to help show you 2 want to see each other regardless of location (i.e. the visitor visa application is not a scam to get your partner to live in uk long term).

Is the wording on that particular question (about having been to the UK before) easy to mis-intepret ?

This forum is for tier1 ....... not for tourist ..

but looking at ur post u say he said NO for "whether he had been in uk before" and rejected till 2018............

everybody who visits uk ,90% most of the time are first timers . I dont understand what u mean .......................looks like there is some other issue ....

sorry i had no idea wht a Tier 1 visa is....got carried away i guess whn i saw the word "General" :D

Both my partner and i are residents in the Republic of Ireland but not citizens, until now i hve not needed a visa to visit the UK being South African but that has changed since, but my partner who is Nigerian does need a visa.

I jus asked him now to explain to me exactly what happened.....now i get the full picture....eejit!!

Apparently he went to belfast for a day trip without a visa and immigration officers stopped the bus and they took his details down. They let him off with jus a verbal warning but apparently they did put it on the system. So then the eejit(my partner ie) said "no" on his application form.....he says he forgot abt it as the Belfast incident happened abt 5 yrs ago.

so thats the story!! I am not so bothered about him getting a visa to the UK...more so about the refusal for visas for other countries based on this refusal.

:? Clearly, you are posting in the wrong forum. Find one for the country you wish to go to!

i am not so bothered, but at some time in the future we might want to go over for a weekend or something, so it still needs to be sorted out if possible.
