In or Out of country applicant???

I work and live in UK for nearly a year in WP.
I dont pay National insurance as I am not paid by anycompany in UK.
I am paid a full salary in India plus expenses and etc., for my stay in UK.
I do pay tax in india for the whole money and have got a form 16.

Now in this case if I apply as a in-country applicant I will be rejected as the bank deposits I receive everymonth is less than 40k. Can I apply as a out of country (i.e)indian resident?

kindly throw light on this issue, so I could either go a head and apply or save the 300 pounds.

question 2: If I manage to stay in UK in WP for 4 years will I be able to apply for permanent citizenship like we do in HSMP???
