Dependent visa and its rights in Germany

Post by markowna » Thu May 07, 2009 9:54 pm

Hi,

Its me again but this time with another question.
This time the question is:
- what are the rights for Non-EU person on dependent visa of the EU spouse

I am Polish and getting married to non-EU fiancee and would like to know what rights my husband will have if he comes to Germany on dependent visa. I have the work permit in Germany and would like to know what rights my husband will have if he comes on dependent (family reunion visa).
Will the fact that he is married to EU citizen make the WP process easier for him?

Please advise

In general your family members can work and live anywhere you go in the EU. If you can work in Germany, then your family can too!

It is worth contacting the EU's Citizen Signpost http://ec.europa.eu/citizensrights for confirmation.

I have also found
http://ec.europa.eu/eures/main.jsp?acro ... s=1&step=2
which is a bit hard to read.

But it has a link to http://ec.europa.eu/employment_social/f ... ion_en.pdf
Family members of a worker from a new Member State
who has been legally admitted to the labour market of an old Member State for 12
months or more, and are legally resident with the worker in the territory of a Member
State at the date of accession, will also have access to the labour market of that
Member State. If the family joins the worker after the date of accession, they will
have access to the labour market [...] from the third year after accession
. ''Family members''
means the spouse of the worker and their children under the age of 21 or who are
dependants.
