Sorry to learn about your circumstances but why would you send application of a deceased person?

Sincere apologies. I did not realise it was a typo. I guess you need to restate your problem. You say your wife's visa (dependant) will be expiring in 2010. but my wife expires may 2009. ?? can you clearly state when her visa expires and when does your's??

I'm confused by your current status. I'm going to attempt to answer anyway, with a couple of scenarios depending upon your status.

If you are currently on HSMP, then your visa is not a dependent visa. If you are renewing your HSMP as Tier 1, and you wish your wife to be a dependent, then I would apply together. You will both be granted the same amount of leave.

If you are an HSMP dependent, then you can renew independently, and you will be granted leave that will end when the primary visa holder's leave ends.

You say that your wife's visa expires in 2010, while yours expires in 2009. This makes me inclined to believe that you are the HSMP dependent, since technically the rules only allow a dependent to have the same length of stay as the primary visa holder. (Thus, your wife's leave would not be able to be longer than yours unless it was not a dependent).

I hope this answers your question, but if you could clarify exactly what leave you currently have, and what leave your wife has, that would be helpful.

I am on HSMP visa while my wife is my dependant. I came to UK in June 2007 and applied for my wife visa as my dependant. Her visa was refused and after an appeal her visa was granted in October 2008, but to our surprise she was giving a visa which will expire in Decemebr 2010. While mine as the main applicant will expire in May 2009

This is a descrepancy on HO part. Your wifes visa(dependent) will automatically expire as soon as your(main applicant) visa expire. So you have to apply for her visa too with yours.
