ILR after 4 years (not 5) for HSMP and maybe for WP (Tier 2)

A Judicial Review is brought that all HSMP holders that entered country before 3 April 2006 will be allowed to apply for ILR after 4 years (not 5).

Same rules should be applied for WP (Work Permit - Tier 2) holders who entered country before 3 April 2006, but unfortunately Judicial Review applies only for HSMP holders.

If you are Work Permit - Tier 2 holder that entered country before 3 April 2006 or you simple support idea that same rules should be applied for HSMP and WP holders (as was the case all the time until now), you can sign a petition here (you must be UK resident in order to sign):

I've done my bit... But when are we going to hear an exact word on this from HO? I thought the announcement was due today, 15/05/09?

It would be great if all WP holders also can follow the HSMP rule of 4 years!!

HO said they will announce on 20/5/09.

I believe the follow up news further mentions the timelines of the implementation.

What I'm not clear about is if you have entered the UK on HSMP prior to April-06 (on 1 yr visa) & got further extention for 4 yrs (as FLR), would those still be eligible to apply for ILR after 4 yrs?
Can moderator or an expert confirms this.

It is not sure what criteria HO gonna to fix to determine acceptance of HSMP on or before 3 April 2006. Guess, there are four groups like within that date

1. Who sent application
2. Who got approval
3. Who got visa
4. Who entered

But if you entered within that date means you must be included within above four groups and you are under ILR JR judgement.

What are the prospects of this going in our favour?
For HSMP guys they had HSMP forum fighting for them but who is fighting our case?

Hi guys,

If you have not contacted your local MP abt this then please do so asap, as we have couple of days for doing so, HO will publish their reply on 20th May. I did and have got a favaourable reply from my MP on supporting the cause of WP applicants.

Because of time constraint, I taking liberty of fowarding the contact details of Anish, aneeshma@yahoo.com , who is spearheading this cause. Please contact Anish for specific information to be sent to your local MP.
