HSMP Application Help

I am writing with regards to the application I need to use for the case I am
about to discuss below:

Initially I was on HSMP status from Jan-06 to Jan-07, I haven't applied for
the extension under this status, since Jan-07 I have been on Work Permit
status which was sponsored by my employer. But now I would like to switch back to the HSMP or Tier 1 status based on the Judicial Review which was issued in April-08.

I have been reading the home office website and the guidance forms, I assume that I need to use the Tier1 (General) version 04/09 as per the instructions in the website. Please see the below questions which I need help for:

1. Which application I need to use for the above situation

2. Am I exempt for the application fee "under the terms of paragraphs

34-42 of the HSMP Forum Ltd. Judicial Review:"?

3. Is there any separate application for dependant (spouse)?

When I called the helpline and asked the above questions different people
suggested me different applications, can someone please kindly advice me.
