eea divorce child help

hi,i am indian living in uk on eea depedent visa.i came in uk on student visa 2004 got married with sweedish girl in 2005 ,got dependent visa in march 2006 as a non eea family member for 5 year.My visa is expiring in 2011 .We have daughter born in 2006.well now unfortunately my wife is not happy to keep this relationship and willing to go back to her ex husband in sweeden.Mater of fact she have already gone.My marraige is 3 year old and we been living in uk for more than 3 years together.Will i be able to get ILR?Will i be able to see my daughter in future?should i inform home office ?i have not recieved any legal notice from her yet,what should i do now,help me out please

If you stayed with her for three years and before the expiration of those three year period she did not leave the UK nor filed for a divorce you have your own right of residence under directive 2004/38/EC.

I presume she took the child to Sweden?

Can other extended family member have their own right of residence under directive 2004/38/EC after 3 years' staying thgether with EU national?
