what to do to get my residence card?

what to do to get my residence card?

hi there,

I am pretty confused about the situation with my passport as i my wife is polish and i am pakistani, i applied for eea2 for the residence card in july 2008 but i still havent received my residence card what shall i do i this situation please anyone who can come up with an appropriate solution as i have rung home office quite a few time but they are unable to say anything as according to them its taking upto a year to solve the issue.

hi there we are many of us out there just like you on the same boat.
it would be very long to try to explain to you what you need to do however i advise you to join EEA2 waiting time thread on this site .
there are a lots of people in your situation and mine and i`m sure by reading and interacting with these good people you will find answers.

but did try shaking the tree by writing complaint e-mails or letters ? did you contact solvit ?did you get your local member of parliament involved?did you seek legal advice?

I know for a fact that a lots of people who applied in june, july and august 2008 have received their precious pass.
on the thread mentioned above there are members who applied in late december 2008 like me who got their papers done already .

for my case i applied via a lawyer and on the day i clocked 6 months he did send a strong letter to the "fate deciders" to look into my case.
i know i haven`t helped much but read people`s experiences on the above thread ,you will see it`s very detailed and precise.
sadely we all feel trapped like this and i feel very sorry for all of us.

I am writing to you with regards to the above application for a permanent residence for a EU citizen L1085638 made on the 21st of October 2008.

I was recently phoning the number mentioned on your web site EEA residency enquiries 0845 010 5200 as I noticed on the very same page that the processing time currently is more than 1 year.

Under Regulation 18(1) and Article 19 of Directive 2004/38, EEA nationals who are entitled to reside in the UK permanently must be issued with a Document Certifying Permanent Residence as soon as possible after the application (plus the proof of entitlement) has been received. In Directive 2004/38/EC the processing time has been set to be less than 6 months. Can you please explain why the processing time is more than 6 months? And can you please confirm when I am to receive my certificate? And as this is now more than 6 month since I applied for the permanent residence certificate can you please explain why you are not abiding to Directive 2004/38/EC?

You should send them a letter, by Special Delivery, noting that they are required to issue the Residence Card within 6 months of the application.

You should also contact your MP and get their assistance.

I did not send signed for letters or go to my local MP to get my Resident card.

I just wrote the email I copied and pasted above got a reply in 3-4 days from customer service telling they had forwarded my inquery to the case working department.

Aprox 2 weeks later I got a letter with my Passport, card and a folder explaining me about my rights to get UK citizenship and nationality of any children I might have or would get.

I did however, not get any answeres to the questions I raised in my email hence I got my local MP to raise them for me as pre http://www.immigrationboards.com/viewto ... highlight= and am still waiting for my MP to come back to me.

In fact I think I will chase him one of these days.
