Can my employer apply for work permit, while FLR app is in? yes i do meet the requirements of Tier 1
Is it feasible for my employer to apply for a work permit now that I have my appeal turned down with the threat of being of being asked to leave within a couple weeks (I can appeal the appeal but the case put forward was poorly handled I do not feel there is much to fight on) , and I have a FLR application (May 07, 2009) which seems to be taking average 6 months,. This time hiring the only legal firm that would accept me at very short notice. I am willing to pay for second opinion asap - if you have any recommendation please email me at grumpytwo2@googlemail.com. 07923555766

Please reccommend immgration lawyers with knowledge and who will take a client at very short notice, prefereably see me this saturday (July 4th in wales or england.

My problem started when After 5 years in the UK but only last two years under the HSMP (granted Nov , 2006, previous 3 under post-graduate doctor permit free visa), unfortunately I made the biggest mistake of my life and my application was made for indefinite leave to remain Jan 2009 a couple of weeks before the expiry date. Because I did not qualify (" not 5 years) under the HSMP I was refused and told unless I appeal I was to leave the country in 10 working days on April 2009. I filed for an appeal within the 10 working days concurrently with Further leave to remain application- the one I should have done in the first place. That failed appeal specifically addresses the refusal Aprill 09 and does not address any other decision or application after that date.

I am not professional solicitor but I think yes you can apply. You have to submit an extra letter with the WP application to revoke the previously submitted FLR application and consider this application.

as i understand you were/are on HSMP Pre nov 06... you can apply for your extn under judicial review.. please let us know if you need more details on the same as for this i dont think u need a solocitor.. (Unless we are talking about something else.)

if you score enough points for Tier 1 HSMP then go back home and reapply from there. Make sure this is done as fast as possible as you do not want to spend more than 90 days outside UK. As long as this is done, and you come back within 90 days you should be eligible for ILR in three years.

Get specialist help from a Solicitor and not from some so called @Immigration Consultants@.
