Will this affect my application?

Hi I have a simple question. I am applying for a Uk Spouse Visa. I am American, my husband is British. I'm in USA and he is in UK. We have been married nearly 5 years now. British Marriage. I have everything together for my Visa Application. All documents are in order and I can supply gud evidence. I have one concern...

If I overstayed in the past in UK, (when I went over to get married in 2004), can this affect my Visa Application? I was on a Visitor Visa which I overstayed for quite a long time. I have been told by a lawyer it will not affect it, but I would like to clarify this...

Also, what if I was recently refused entry? Does any of this affect the Spouse Visa Application? Any advice will be really appreciated.

Can they refuse my application just for this reason?

Hi Sabah,

Office may not refuse your application but he may ask to clarify why u overstayed there for longer period. So be prepared to answer this question. :)

Hi Akash, thank you for getting back to me.

I have written a full 2 page letter to Home Office regarding my Overstay. An apology letter as well as explanatory. It covers everything. Will this suffice?

Also, I hope you dont mind, but I have one other question. During my overstay, I got my provisional driving license in UK. As well as bank account. I have heard recently that this is not allowed unless you are a permanent resident in UK. I was not aware of this. I was not questioned regarding my status when applying for either of these 2. Do I need to disclose these to 2 things in my letter as well? I was also going to send these documents in with my application as they also show proof of address where I stayed (with my sponsor - husband).

Any info appreciated - :wink:
