How many days absences for citizenship

Post by racingfire » Mon Jul 13, 2009 9:03 pm

Hi,

(1) My friend has completed his 5 years of residence in uk, now he is eligible for citizenship. But he had 492 days absence from uk in last 5 years due to his illness. He did not have any absence in his last year.

(2) If he is eligible for citizenship , can he applied with his dependents, he had 4 kids , in which 2 of them were born here in uk. But 2 of them were not born in uk. So the kids who were not born here, are they eligible for citizenship or not?

Any professional advice will be much appreciated.

First things first. Does your friend have indefinite leave to remain (ILR) or permanent residence under EU/EEA rules or right of abode? You can't just apply for citizenship on the basis of being resident in the UK for five years. You need to have been granted ILR/permanent residence/right of abode first.

Unless your friend is married/civilly partnered with a British citizen, if he has ILR, he will need to wait one year before he applies for citizenship.

So two questions:

1) does he have ILR/permanent residence/right of abode
2) is he married to a British citizen

Your question can't be answered unless you answer these two questions first.
