4 Year ILR Rules (JR 6 April 2009)

4 Year ILR Rules (JR 6 April 2009)

I have a query regarding the new 4 year ILR rules (Judicial Review judgment of 6 April 2009).

I had initially applied for my HSMP approval in January 2006 which was refused due to error in assessment.

I, therefore, re-submitted a fresh application on 26 April 2006 claiming the same points and using the same documents as I had done in January 2006.
This time was application was approved and my HSMP approval letter is dated May 2006.

However, the reference number on my HSMP approval letter is the same as the reference number mentioned on my first refusal letter (January 2006).

My query is regarding my qualification under the 4 year rule. Since I had initally applied before 3rd April 2006, do I qualify under the judicial review judgement of 6 April 2009 to apply for ILR after 4 years?

its ment for applications made before but approved on the basis of that application. so in your case it may not apply as your sucessful application was based on an application made after 3 april 06

sorry, i don't think you qualify. this is because you made a "fresh application" so your date of application is 26 april. if you appealed january application, then january would be considered as the date you applied.

Since this is a rare issue, best way would be fire a query to UKBA on email and see their response.
