EEA Permit Application in Dublin

Has anyone applied for an EEA family permit at the UK embassy recently and how long did the process take?

To be honest i do not think i have an answer to how long UK embassy in Dublin takes to decide a family permit application.My friend's application has been with the embassy in dublin for well over 7weeks now.He is actually frustrated because of their long silence.Refusal or Approval,why cant somebody say something instead of making people's lives miserable?
Correct me if i am wrong

Dear xxxxx,

Thank you for your letters regarding your complaint registered under reference
2008/098.
On 10 December 2008, the Commission adopted its report on the application of Directive
2004/3 8/EC. You can download the Commission report in English at

The report found that the UK does not provide for the visa exemption for family
members holding a residence card issued by another Member State.
The report highlighted that additional practical problems encountered by third country
family members are caused by the failure to differentiate between third country nationals
and third country family members of EU citizens, who enjoy certain rights under the
Directive. The latter are still often required to submit a range of documents with their
application for an entry visa, such as a proof of accommodation, sufficient resources, an
invitation letter or return ticket.
ln the report, the Commission stressed that it will step up its efforts to ensure that the
Directive is correctly transposed and implemented across the EU. In order to achieve this
result, the Commission will use fully its powers under the Treaty and launch infringement
proceedings when necessary. Once the recent amendment of the Immigration (European
Economic Area) Regulations 2006 which became applicable on 1 June 2009 has been
fully analysed, the Commission will contact the UK authorities to obtain clarifications.
To provide Member States with guidance concerning entry visas, the Commission
addressed this issue in its recent guidelines for better transposition and application of

As far as I can see this amendment mainly deals with changes in deportations and exclusions.

I spoke to a lady at the EU office in Brussels yesterday and she said that the UK was currently amending their EEA Regulations 2006, she said that some recent guidance (June, 2009) was despatched to all member states i think she meant the last web link in the letter.

Yes, the last link refers to the report from the Comission published June this year. The UK amendment from the same month (my link), however, does not mention anything regarding the residence card problem.

Residence cards issued under Article 10 of the Directive to a family member of an EU citizen residing in the host Member State , including those issued by other Member States, exempt their holders from the visa requirement when they travel together with the EU citizen or join him/her in the host Member State.

Residence cards not issued under the Directive can exempt the holder from the visa requirement under Schengen rules[22].

Yes, that's it. The SI 2006/1003 and SI 2009/1117 stil interprete 'residence card' as only the one issued by the UK.
SI 2006/1003, Regulation 2 wrote:"residence card" means a card issued to a person who is not an EEA national, in accordance with regulation 17, as proof of the holder's right of residence in the United Kingdom as at the date of issue;
Regulations 17 disucess the details for the UK residence card.

No news from them yet? Perhaps, you should consider lodging a complaint to EU commission or Solvit. Alternatively, you could send a complaint letter to the British High commission.
