I am posting on behalf of my best friend.
He is her in the UK as on a dependend visa and his wife is a student.
He applied for an extention of stay on 26 February 2009 for further leave to remain as as a spouse and his wife as a student via post registered.
Their current leave to remain expires on the 28 February 2009.
However, the application form was filled wrongly and the college was not a approved college list in HO category. The form was refilled and was sent back within a week to HOffice.
Now his visa has been rejected and the letter states no appeal against this decision and has asked him to leave the country within the next week on the folloing grounds:
a - when the application was submitted he did not have a valid leave to remain. We presume they are arguing on the date when the correct application was sent in .
b - the college was not recognised in H.Office approved list.
Any suggestion if he can win an appeal :
1 Getting a new approved college letter
2 stating that his initial application was sent via post before his expire of leave to remain?
