Citizenship rule not changed for HSMP !!!!!

Post by sanjana » Tue Sep 08, 2009 7:20 pm

Hi friends,
i received reply to my objection for path to citizenship bill from Mr. Woolas, the immigration minister.

It says those who obtain ILR before the commencement of new rule before july 2011, will be eligible to apply for citizenship with a grace period of two years ( i.e July 2013) from july 2011.

He also stated " THOSE MIGRANT WHO ENETERED ON HIGHLY SKILLED MIGRANT PROGRAMME WILL ALSO BE ABLE TO APPLY UNDER THE SYSTEM AS IT WAS THEN WHEN THEY APPLIED TO THE PROGRAMME"

So it does says immunity for HSMPians but i dont know what happens if some one needs to apply for citizenship after JUly 2013 whose initial leave to remain is under HSMP.

Your thoughts welcome.
Thanks

so does it mean if some one in HSMP, for example my case, i entered UK on HSMP end of 2007. so i will not have ILR untill end of 2012. so will i still be able to qualify under old rule? or as it says ILR has to be before july 2011 to qualify for old rule?

1. Post a copy of full reply from the minister on the board.

2. Keep a copy so that we can use it against the new minister we might have then. :D

Please email your original email and his response. Based on what you have quoted above, I think what Mr. Woolas means is that HSMP applicants too would be eligible to apply for citizenship by July 2013 (including 2 year grace period) if they got ILR by July 2011. Nothing new in it - thats how the current bill reads.

WHY 2011

Post by nionlight » Tue Sep 08, 2009 9:30 pm

why Home office chose 2011? whom they are covering? atleast they should set the rule so that all HSMP holders who are already in UK are covered by OLD rule as they were promised. why this random 2011? where some one will be covered and some wont? its redicilous...

Might be wrong, but I thought it was july 2011 because the new rules became law in july 2009 so it give the BIA 2 years to sort out the new processes.

i strongly feel the govt. will not make another mistake similar to what happned in hsmp jr.

if they bring this rule all of a sudden in july 2011 without covering those who enterd under hsmp rule, then I see its going to be a failure?

I think before commenting further on this post we need to see 'original email' and 'response' from the minister. As this could purely be another rumor..

i really hope HO will not break promises as usual  .. even though i dont trust them a single bit. but unfortunately this new law has been passed in the parlament with royal ascent or whatever it is. so may be high court will not go against a decision that is made in parlament. lets see what happens...

Read the comprehensive post under another sub forum. The date July 2011 was announced during the discussion on the Bill. Lets see what the final act and rules say.

Can you consider to send a email copy to HSMP Forum Ltd. as well?
The more people retaining this evidence, the less chance government can deny later.

This thread / alleged letter from Phil Woolas sounds very dodgy to me. This has been going on for 2 weeks now and there is no evidence, just a lot of playing with words / postponing from the original poster.
How hard / time consuming could it be to type a few lines ? Think about it.
I hope I am proved wrong but I think someone is having some fun / playing with peoples hopes, at the expense of honest hardworking HSMP migrants.
