Hi Guys,

I was on HSMP and got a Tier1 extension. My question relates to ILR

- Is there a maximum number of days that one can stay out of UK in the 5 years preceeding ILR?

If yes, where is the rule on UKBA website or any other link that you have? Some people say it is 183 days but i cannot find any such rule on ILR form or UKBA

- I came 3 months after grant of entry clearance to UK. It was granted in Jan 2007 and I came in Apr 2007. Will i have to apply for ILR in Apr 2012. In that case my Tier1 will lapse. So will i have to reapply for extension before ILR as that will cost me money?

Section 6A - Points-based system, tier 1 settlement guidance.

You may apply for settlement no sooner than 28 days before the completion of your qualifying period and before your leave expires. Unfortunately, if your leave expires before you can apply for settlement, then you should apply for an extension (cost), before your leave expires.

ILR - Seeking Guidance

Hi,

I am affected by the HSMP forum's recent JR and requiring to apply for my FLR in December 2009. I have couple of questions relating to getting some clarification on the guidance HO has quoted in the application.

a) In the SET(O) application form under section 9(A) in Finances; they've said the documents should be at least covering past 3 months. But further down in section 9(H) (presuming this is where I am falling into), they go on to say "documents showing your economic activity and your personal earnings during your stay in the UK".
So I am confused now whether to show the evidence of documents for my previous 4 years or is it just for 3 months, appretiate anyone who can clarify this to me...

b) My original visa is granted until Dec 2010, since erlier the qualifying period was 5 yrs. Will there be any negetive consequences if I apply slightly after spending 4 yrs, Like in January or Feb 2010. (Due to some personal commitments)

Dear senior members

I understand the 28 days rule on the link but i have peculiar situation. My FLR extension letter says that it is under JR and sufficient leave to take me to qualifying threshold for settlement.but time line is as follow.
Visa 19 jun 06 till 19 jun 07 stamped on 19 jun 06
Extension until 19 jun 08 stamped on 9oct 07(To correct mistake while issuing first visa which should have been for 2 years)
FLR for 3 years till 4 Aug 2011 with above statement stamped on 13 Auf 2008
I landed here on 14 sep 2006 i.e approx 3 months late.
How do i go about it for ILR in 2011
Do i need extension as i am short by 40 days or UKBA committment that my FLR is sufficient to take me to qualifying threshold for settlement will be honoured

I WILL APPRECIATE your comments and personal experiences
