ILR qualifying date - Help required !!!

Hello,

I entered in UK on Work permit on 7th Dec 2004 and I shifted to HSMP on 5th Nov 2006. My HSMP visa is validity till 5th Nov 2009. This is 3 days short for qualifying period for applying ILR.

Please can you suggest whether I can apply for ILR by post on 5th Nov or I need to go for HSMP extension under Tier1(HSMP) and then apply ILR.

I already checked with a Solicitor and they are suggesting to go ahead to apply ILR by post through them and there is no need to apply for HSMP extension. They told that Home office will have some authorities to approve. My worry is that I may require to leave UK in case of visa rejection as my visa will be expired by then and there is no chace to appeal.

Please can you suggest your views on this. Your help will be much appreciated.

You can apply 28 days before your qualifying date.

So you can apply 28 days before 7 Nov 09 in your case.
