ILR vs BC for kids

Post by Blessings » Wed Jul 13, 2005 4:02 pm

The goog people of this forum please help.

A friend was granted ILR late last year (Nov. 2004) after 4 years on WP. His wife and their two kids (one was born in 1991 and the other in 1985) were also granted ILR. Both were born outside the UK but came with parents as dependants.

The questions are:
Can the children register as BC?
If yes, when can they do this?
Or do they have to wait to complete one year on ILR and apply for BC?

Any comment(s) will be vey much appreciated.

If the children had been born in the UK, and now the parents have got ILR, then it would be possible to apply to register the children as British now.

However as the children were born outside the UK then it is a question of waiting until the children can "piggy-back" on to the application for Naturalisation being made by the parents.

So when the parents apply for naturalisation .... November 2005 ? ... one of the parents should include the children on their naturalisation application form. Then when the parent is granted Naturalisation as British the children will be Registered as British.

Sorry, just realised the children are now aged say 14 and say 20. So certainly the younger child should be entered on to the parent's application form. But I think the older child will need to apply for Naturalisation in their own right ... when they have had ILR for at least a year .... and of course they cannot apply until they have been in the UK at least five years.

Application for BC for kids has to fall under one of the categories mentioned on the IND website.

For example, I applied under SECTION A where the children are born in the UK. I applied for the their BC since they were born here and we were later granted ILR.

In your case, I think you have to wait for 12 months.

Additional information please. The father completes 5 years in Nov. 2005 but wife completes 5 years in Jan. 2006.

What is the most viable option:
Husband starts Naturalisation process in Nov. 05
Wife start starts Naturalisation in Jan. 06
Or Husband and wife start Naturalisation in Nov. 05 (cheaper)
Or Hushand and wife start Naturalisation in Jan. 06

Thanks in advance
