Fiancee visa advice

Post by Fearandloathing » Fri Oct 30, 2009 9:52 pm

Hi there folks thought i would seek a little help from the good and wise on here.,
My situation is i have been with my partner for 8/9 months and next week she is flying back home to Australia and will be applying for a Fiancee visa.
She came here on a working/holiday 24 month visa but has been unable to work in the uk for the past 7 months approx as i'm sure most are aware she was only able to work 12 of the 24 as a result i have been supporting her during this time. I am now a little low on funds so was thinking about waiting until January to apply when i will have saved up £2000 as i'm thinking this will look better for the application. I currently take home £1350 per month and pay £350 per month for accomadation which is shared(i do have a room which meets the 50 sq ft requirement) including bills ..this accomadation is temporary and will be getting a flat of our own but was thinking using my current address for my application as can get a letter stating i have the place for 12 months which i believe is also required. I am now just trying to get together any evidence i can which so far consists of
6 pay slips
going to get a 6 month bank statement nearer the time ( when my account looks better)
copy of p60 from inland revenue
copy of contract of employment
my passport or will a copy / photocopy do?
copy of my booking for the wedding from the reg office
photo's of myself and partner together
birthday card
Christmas cards to each other
copy of phone bill highlighting her number
copy of emails sent to each other
was thinking of a letter from friends and family verifying the relationships real? also would i need a copy of their passports to accompany any letter?
letter from landlord (family) stating rent and agreed lease time (or would i need a proper rental agreement?)

anything else im missing?? also can anyone reccomend a good and reasonable solicitor as im terrified i'll make a mistake in the application and £350 is a price im willing to pay for piece of mind

many thanks in advance :)

Just reading this back to myself ..apologies..does seem a bit of a dog's dinner  i was trying to cram in as much as i could in my 10 minute tea break . Anyway the main things i was needing help with were

1 . what if any documentation is to accompany letters from family and friends supporting the application?

2. Will applying from a shared accomadation have a negative effect on my application?

3. What documentation will be required to prove my accomadation is suitable ?( room being over 50sq ft and having the option to remain in the property for at least 12 months)

4 Lastly is there anything else i should be looking to add evidence wise? or anything else i should know?

many thanks in advance

The docs that you have listed in first above post should suffice for this purpose.

As regards above

1. Not really required

2.No it should not if you share with family. You just need a letter from parents stating that you and your fiancee can stay here temporarily untill such time you find your own. If you rent from landlord you need a shorthold assured tennancy agreement (pref 12 months).

The only time it may not be accepted by an ECO where you share a house with friends and you jointly contribute the cost without having some form of agreement in place giving you some rights in case there is a dispute amongst you, and there is a possibility that you and your fiancee may be kicked out by other occupiers. This is what the ECO may class as "temporary accoomadation" rather than secure which the above two are ( more or less)

3.If you are living with parents and there are others living in the same property, you will need a report from your local council confirming that the house will not be overcrowded ( see above sticky post for overcrowding regulations )

4.It might be a good idea that copies of your passport pages be certified by a solicitor confirming that they are true copies

Other than above you should be ok.

You have prepared and thought out the matter carefuly which I hope bodes well for your future as well mate

Good luck

Thanks for the feedback batleykhan very much appreciated mate...i'll get in touch with my solicitor about verifying the passport copy or if i'm going to get one of these "visa specialist" solicitors to assist i'm sure they could verify it for me.

Thanks mate i'll get that done on Monday. Perhaps you could help me with another couple of queries . Firstly i know one of the questions in the application asks about what plans for employment my Fiancee has when she comes over here, she has previously worked at my place of employment as a temp worker and is hopefull of getting something sorted at the same place ..will a ref from her boss and perhaps a wage slip (if she has one) be enough for evidence? alternatively she was also thinking about doing her bus test as she already has an hgv ..is this allowed before the marriage?
Secondly i'm a little concerned over how much funds is considered sufficiant to have saved in my account ..i will have about 1500 maybe 1600 (minus the 585 for the application and any solicitors costs) by christmas and was curious if this would be enough as i was going to wait until i had 2000 in January but ive booked the wed for the 3rd june soo thinking this might be a bit tight with regards the application getting approved in time...any advice greatly appreciated mate

ps just trying to get as much sorted before she leaves this week
cheers
