applying for Intra Company Transfer with expired H-1b

Hi,

I switched employers in the US and re-entered the country with my old employer's H-1b visa stamp, but new employers I-797A. I thus have an I-94 from my new employer.

I am applying for the Tier-2 Intra Company Transfer. What immigration proof do I need to send? My company lawyer is happy with the I-797 and I-94. I just wanted to double check from this forum as to whether the EC officer will look at my expired H-1b from my old employer and raise a fuss about it.
