Stayed out of UK

All,

I am having a valid HSMP visa till 2011 march but last 9 months i was out of UK. Now i am planning travel this year end so just I want to know, is it any issue will be created immigration check ?
Also, I will be having an offer letter from the UK firm. How to handle this situation? Any thoughts!!

That shud b a problem at immigration. As now u got proper job too u shudnt have any problem at all. U can enter UK anytime till ur HSMP is valid.

Did u enter UK after u got ur HSMP??

at present only those who r less than 180 days gone out are considered by HO FOR ilr in 4/5 yrs

Yes, after my visa I have worked almost 2 years and left.

Yes I missed the continuity of the ILR.

Other query is:
Initially I got hsmp 2 years then again I have extended for another 3 years with new tier1 rules. Since I lost my ILR eligibility, after 2011 shall I apply the tier1 visa again based on my new eligibility?
Also I have heard that, Master degree is mandatory for new points based system so do I need to have master degree? Or I can claim the points using degree?

NO as per high cour ruling u need to show economic active and no msaters degree required

u should get ilr in 4 yr period

this is my strong view rest others r their to iterpret high court judgement

but u should be given above mentioned benefits

U NEED TO stay 4 continuous year and 180 maximum days out (90 day one shot rule is there but yr total 180 days r not out of uk than home secretary may condone it)

u will get extn defanitely to get ILR and to show economic activity

Actually it is not a tier1 extension; My two times (2+3) hsmp visa period will be over by 2011. After this i can't apply ILR due to out of UK issue.

It means, I need to apply a fresh tier1 visa to complete another 5 years to get a ILR eligibility (3+2). Here what are the new rules for getting eligibility? is there any HO link or documents to get more info on this.

you shouldn't need Masters degree as it will be an extension case. ILR is a separate issue altogether.
