VISA Start date and ILR

VISA Start date and ILR

Hi

My visa has been issued from 9 November 2009 from Delhi.

If I am not able to move to the uk before 8 February 2010. Will these 3 months be considered as time outside the UK.

From what I understand at the time of applying for ILR, in the preceding 5 year period the applicant cannot be outside UK for more than 180 days and no single visit outside the UK for more than 90 days.

If I do not enter before 8 february 2010, will I be disallowed a ILR on being outisde UK for 90 days .

Your counter will start from your date of entry in uk
and so as 180 days leave as well.
unless u enter the uk, your counter toward ILR wont trigger.

Hi

Please validate the following timeline

Date of issue of tier 1 : 9 November 2009

Let's assume date of entry : 10 December 2009 , based on this eligibility for ILR is on 10 December 2014

Date of expiry of tier 1 : 9 november 2012
Extension of 2 yrs : 9 november 2014

How do i cover the period from 9 November 2014 to 10 December 2014

You have to again apply for extension of leave, before you can apply for ILR. Although rules can change till then, so be cool!!

During your extension mention in your cover letter to grant you visa for extended period. You need only 4-5 days in this case. Caseworkers do grant visa for little extended period(or from a particular date)..but this cannot be gauranteed.

Besides, you can apply for ILR 28 days before your leave expires so you can plan accrodingly without going for second extension.

B-U-T, that time is very far from now and there are more changes in rules coming along.
