Query on Dependent Application Question J5 Page 29.

I have a doubt on question J5 of the Dependant application (Page 29).

I am currently in HSMP and need to get Further leave to remain on Tier 1 General for myself and two dependants.

For question J5, am I correct to think, I need to tick the second option, An extension of his / her existing leave? It then asks me to go to Section L. Does this mean, there is no need to show any maintenance funds for my dependants, as section K becomes irrelevant for me?

Please clarify.

J4. Has the main applicant applied to have his/her application assessed in accordance with
paragraphs 39-42 of the HSMP Forum Ltd. Judicial Review Policy Document?
Yes No
Now go to question K1
You should watch out question J4. So you should move to K1 if you say No to J4!

I think only the Yes part in J4 directs to K1. My answer to J4 would be No. Hence I need to answer J5.

Will be helpful if someone who has filled this recently clarifies.

Hi,
I think you have to answer K1 regardless of the yes/no option and don't skip to L directly, your form may be returned because it's not fully completed. Since your answer is No then you have to skip J5 then fill K1 and then K3 after that L.

Sorry, I am still confused. I will explain in detail.

Question J5 on Page 29 of the dependant application is

J5. Is the main applicant making an application as

An Intial (switching) application - Go to question K2

An extension of his / her existing leave - Go to section L

A result of change of employment - Go to section L.

My case is extension of existing leave (from HSMP to Tier 1 (G). I assume I need to select the second option, whereby I will go directly to section L. In this case, does it mean, I do not need to fill section K1, to show maintenance funds for my dependants. Please clarify.

Hi,

I had same doubt and called up HO. Even they were confused. HO advice is that fill section K though J5 suggest you to go to Section L.

I mentioned in the covering letter about this confusion and submitted it today.

So i think it is up to HO to decide how they go forward. They are to be blamed for this and not us.

I would not take that risk. Fill in the Section K1 and K3, after J5 and mention that in covering letter.

Thanks for the response everyone.

I called Home Office this evening and was told the following.

J1 Yes
J2 No
J3 Tier 1 General
J4 No Then go to K1

Fill K1, K3 and then go to L.

This made sense after they explained. The confusion is after J4. The note go to K1 applies to the whole of J4 and not just the Yes part.

Hope this helps.

The HO person agreed that this sounds confusing and told me that he will pass on the comments.
