I am under immense stress due to my impending divorce. I am on a Tier 1 Highly Skilled Dependant Visa. My husband has given a divorce application and it is going to happen very soon.
My current visa is valid till 2012, please tell me what alternatives I have?
Can I get any consideration on compassionate grounds.
If anyone can recommend any good immigration lawyers who deal with such cases, that will be really helpful.
Please guys help me out.

IN given scenarion it is hard to get extn , unless yr hubby supports u in getting extn. and then in PR , (without separation )

If you qualify on your credits, apply for your own T1. I know some one who went this way.

I would advice the same as nksg. You can see some immigration lawyer and check with them. I have sent details in your IM.

U should go for police / good lawyers help, if he brought u here to just for fun (dont take negative )
or to acheive his some purpose now he want divorce u than at present u r in strees but if that u can prove his objective than HO will give him real stress.

U should go for police / good lawyers help, if he brought u here to just for fun (dont take negative )

I am planning to go this way as well. I am holding an Hsmp dependent visa and will apply as main applicant myself soon. Can I ask whether your friend applied in the UK or his/her own country? Is there anything different that i should take note of?

This is generic.. as in this case you will come under switching policy (from dependent to T1) and this should be done from your home country.
The person i know went to the home country early this year for the purpose and got approval in less than 30 days.
I am aware of her case if you would like more information please feel free to ask.

To the best of my knowledge there is no switching in UK from dependant Visa to Tier 1.
You have to get entry clearence from your home country for Tier 1.
Confidently apply for your Tier 1 from your home country as metioned by nksg and all will go well.

Thanks for the reply. Does your friend need to register with the police, if yes, did she submit her police registration? The application for applicants outside of the UK does not requir this, however, I have lived in the UK in the past year and should register with the police. It's a dilemma coz I did not register one of three address I've lived and part of bank statements and payslips were sent to that missing address. A bit worried that this could be an issue.

Hi Delhi Girl,
I have almost the same situation here regarding the dependent visa after divorce.
Having talked with UKBA, it seems that unless the main applicant informs the UKBA, the dependent can stay legally in UK.
Additionally, even if informed it will take a few months before any action is taken by UKBA given the number of enquiries.
You can probably extend the stay by exchange of correspondence with UKBA once they contact you. This should give you additional time to stay in the UK.
Hopefully this should serve the purpose until the stay in UK expires.
