Immigration Court's key decision on 10 years residence

Immigration Appeal Tribunal has made a decision and allowed the appeal of a person who has got 4 months gap within 10 years period.

I am not a solicitor at all but my undertstanding is HO now has to make a fresh and legal decision as HO did not consider the factors in 395C of immigration rules. This rule says HO takes into consideration of the person's age, residence time in UK etc.
