Non-Disclosure of Road Trafic Offence for my PSW

Post by dewales001 » Mon Nov 30, 2009 7:05 pm

Hi Guys,

Can someone please advice me about non disclosure of traffic offence in a previous application of Leave to Remain. I got an extension for my student visa last year without disclosing the traffic offence in my application form, which was a mistake on my side.
The problem now is that, I want to transfer my status to PSW later in the month of December and I'm planning to disclose this offence in my new application. I have an in-person appointment in one of the HO center, but I'm scared they might refuse my application on the grounds of 320(7B) i.e. failing to disclose a criminal conviction in a previous leave to enter, remain or visa application.

I need help please!![/i]

Did you go to court or was the case heard in court?

I didn't attend the court session, but the case was heard in court. I was fined £200 by the court and it has been paid.

I think you should mention that as your case was heard in court so yeah it was criminal conviction and you have been charged so go ahead no need to hide any thing, HO looking for way to send people back home by rejecting their visa and by not disclosing you are giving them a reason to refuse ..

I would suggest to disclose your offenses in application. I dont think they will check your previous application. But if you dont disclose that might be a reason for caseworker to reject your application. You shouldn't give a chance to do so.

I was in the same situation as you. I declared my traffic offence and got my PSW visa, so my advice would be just declare it.
