Yes it is correct; it’s happen to my sister as well. (Please look at bold sentences carefully - this advice given by university legal adviser)
She has finished her course early December. But her Legal Adviser from the university said that she cannot apply after finishes her studies. She should apply while she studying at least 15 hours at the university.In order to benefit from this suggestion, your application must be made in time and prior to the course ending
Following advice given us in August but at that time we thought we can apply end of the course. But we couldn’t now she left the county and waiting for her finial result with a letter from the university to apply for PSW in January from our country.
Her advice to my sister in August while she is studying at the University: (Legal Adviser)
- Assuming you satisfy the Tier 4 Immigration Rules, and assuming University is willing to confirm your re-sit status, you can make a request for leave afresh and the "extra time" to which all Tier 4 students are entitled
- It is possible for the Student Batch Scheme to grant you an extra 4 month period (i.e. 4 months from the end date of your programme) if your course is still running at the date of decision- Submitting an application via the Student Batch Scheme (i.e. through me) would be the only solution
- Paragraph 245ZY(b) of the Immigration Rules obliges caseworkers to grant not just the length of the course, but a set period of time afterwards (in your case, 4 months)
- This time is valuable to you because it will give you enough time to wait for the results of your course and then make your next immigration application under Tier 1 (Post-Study Work) - assuming you successfully pass your programme
- The application fee still applies (£357) if we submit via the Student Batch Scheme
- In order to extend your visa for this additional 4 month period, you must still satisfy the very strict immigration rules in relation to Tier 4
- In order to benefit from this suggestion, your application must be made in time and prior to the course ending- Assuming you successfully complete your programme, a further immigration application under Tier 1 (PSW) can then be made
- Should you fail your programme, you will not be able to make a successful immigration application under Tier 1 (PSW); neither will University continue to sponsor you under Tier 4. Your only option would be to return home or switch into a different immigration category if eligible to do so.
